General Conditions
The Customer is required to carefully read the terms and conditions of the “Legal Notes” that have been made available to him on the Site shop.iltrenino.info is owned by ELE srl and is managed by ELE Soluzioni srl with registered office in Milan (Italy) Galleria San Babila 4/C, 20122, VAT number 01716790462. ELE srl is the sole owner of the rights to domains, logos, trademarks, copyrights applied to the Site and the Products.
Products
The characteristics and prices of the Products are shown in the offer relating to each individual product present on the Site. All Products placed on sale online are subject to actual availability.
Price
Product prices are expressed in € (Euro). For Products shipped within the European Union, prices include VAT.
How to purchase
To complete the order, the Customer must register in the Store by entering the mandatory data and choosing a password. All details relating to the data processing methods are communicated to the Customer at the time of registration.
Deliveries
Products purchased on shop.iltrenino.info are usually delivered in 6-9 working days, following receipt of payment, with an express courier.
Couriers deliver from Monday to Friday.
The risk of transport and certain costs, such as storage costs at the courier, remain the exclusive responsibility of the Customer in all of the following cases:
- Customer's refusal to receive delivery
- unavailability of the Customer during working days during office hours
- presence of errors in the data indicated by the Customer

GENERAL CONDITIONS OF SALE
1. General Conditions
1.1 The Online Store, shop.iltrenino.info (hereinafter, "Store"), the brand IL TRENINO / IL TRENINO MINI / OIOO are owned by ELE SRL (hereinafter, "ELE") and are operated by ELE srl with registered office in Milan (Italy) Galleria San Babila 4/C, 20122. n. 243, VAT number 01716790462 (hereinafter, "ELE"). ELE is the sole owner of the rights to domains, logos, trademarks, copyrights applied to the Store and the Products.
1.2 These general terms and conditions of contract (hereinafter, "General Conditions") govern the relationship between the customer (hereinafter, "Customer") and ELE (jointly, hereinafter, "Parties") for the purchase of ELE products (hereinafter, "Products") from time to time made available for this purpose in the Store. The language available for concluding the contract is Italian.
1.3 The Customer is required to carefully read the terms and conditions of the "General Conditions" that have been made available to him on the Store, in order to allow their storage and reproduction pursuant to art. 12 of Legislative Decree 9 April 2003, n. 70. (Implementation of Directive 2000/31/EC)
1.4 Contracts concluded with ELE, by accessing the Store, are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 (Consumer Code) and by Legislative Decree 9 April 2003, n. 70 (Implementation of Directive 2000/31/EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce).
2. Product Availability
2.1 All Products offered for sale online are subject to availability at the time. ELE reserves the right to vary the quantities and/or types of goods that can be purchased at any time. The Customer will be promptly informed if his/her order cannot be fulfilled due to the unavailability of the ordered product.
- Price
3.1 The prices of the Products are expressed in € (Euro). For Products shipped within the European Union, prices are inclusive of VAT. Delivery costs are excluded.
3.2 ELE constantly verifies that all prices indicated on the Store are correct, without however guaranteeing the absence of errors. In the event that an error is found in the price of a product, ELE will give the Customer the possibility of reconfirming the purchase of the Products at the correct price or cancelling it.
4. Purchase methods
4.1 The characteristics and prices of the Products are shown in the offer relating to each individual product present in the Store.
4.2 To purchase the Products, the Customer must complete and send to ELE the purchase order form in electronic format, following the instructions contained in the Store. To complete the order, the Customer must register in the Store by entering the mandatory data and choosing a password; all details relating to the methods of data processing are communicated to the Customer at the time of registration. After having viewed and accepted the contribution for delivery costs, as well as the General Conditions, Privacy Policy and conditions on the right of withdrawal, the Customer must select the desired type of payment and send the order. By sending the order to ELE, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and that he fully accepts the General Conditions, even those referred to via links.
5. Conclusion of the contract
5.1 The Contract stipulated between ELE and the Customer shall be deemed to be concluded when ELE sends you Confirmation of Order Acceptance via email.
5.2 ELE will send the Customer, by e-mail, a confirmation of acceptance of the purchase order sent by the Customer, containing a summary of the essential characteristics of the Products purchased, the date of placing the order, the chosen delivery address, the detailed indication of the price, the payment method chosen by the Customer, and the delivery costs. The Customer must promptly verify the content of the communication and immediately report any errors or omissions to ELE. In the event that the Customer does not receive the confirmation of acceptance of the order within 24 hours of placing the order, he/she is required to promptly contact ELE at the address: info@iltrenino.it
5.3 If the Customer requests it, only at the time of sending the order, ELE issues an invoice for the goods shipped, sending it via email or post to the person placing the order, pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. The information provided by the Customer at the time of ordering will be used to issue the invoice. No changes to the invoice will be possible after it has been issued.
5.4 Orders will be archived in the Store's database, in compliance with the provisions of Legislative Decree of 30.06.2003 n. 196 and will be accessible in the "MY ACCOUNT" area, "ORDER HISTORY AND DETAILS" section.
6. Payment Methods
6.1 The Customer may pay the price of the Products and the related delivery costs by Credit Card, Pay Pal or bank transfer.
6.2 In case of payment by credit card, the Customer will be directed to the website page of the bank that owns or manages the “online” payment service, to which he/she must communicate his/her credit card details via a connection protected against unauthorized access, through the encrypted transfer of SSL (Secure Socket Layer) data at 128 bit. Such data are not accessible to third parties, not even to ELE. For administrative accounting needs, ELE reserves the right to verify the personal details provided by the Customer. The transaction will be charged only after the debit authorization has been received from the company issuing the credit card used.
7. Transport and delivery
7.1 For security reasons, a signature from someone over 18 years of age will be required upon delivery. Deliveries to PO boxes will not be made.
7.2 Delivery costs are the responsibility of the Customer and are clearly highlighted in the order form. They may vary depending on the shipping method and the destination of the Products. Shipments outside the European Union may be subject to import taxes or customs duties. These amounts, determined when the Product enters the country of destination, are the responsibility of the recipient and are not calculated in the order total. It is the Customer's responsibility to pay import taxes or customs duties, and other appropriate charges in his/her country of residence.
7.3 Orders will be processed and delivered from Monday to Friday, excluding holidays and national holidays. ELE is not responsible for unforeseeable delays, it being understood that, except in cases of force majeure, the Products will be delivered within a maximum period of 9 (nine) days starting from the day following the day on which the Customer sent the order to ELE.
7.4 The presence of the Customer or his representative at the recipient's address indicated in the order is required for the delivery of the goods. Upon delivery of the goods by the Courier, the Customer is required to check: (i) that the number of packages delivered corresponds to that indicated in the waybill; (ii) that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials. Any damage to the packaging and/or the product or the lack of correspondence in the number of packages or indications must be contested immediately, by placing a written control reservation on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of the goods delivered. The Customer must, without delay, communicate any problem by writing to the address: info@iltrenino.it
7.5 If ELE is unable to deliver the ordered goods due to the subsequent unavailability, even temporary, of the Products, it will promptly notify the Customer, and in any case no later than 30 (thirty) days, by email. The amount already paid by the Customer will be refunded as soon as possible, and in any case no later than 30 (thirty) days from receipt of the purchase order.
7.6 ELE will send the Customer a confirmation email once the Products have been shipped.
7.7 The risk of transport and certain costs, for example the cost of storage at the courier, remain the sole responsibility of the Customer in all of the following cases: refusal by the Customer to accept delivery, unavailability of the Customer during working days during office hours, refusal by the Customer to make the cash on delivery payment, presence of errors in the data indicated by the Customer.
8. Right of Withdrawal
8.1 Pursuant to art. 64 of Legislative Decree no. 206/2005, the “Consumer” Customer (i.e. a natural person who purchases the goods for purposes other than any business or professional activity carried out) has the right to withdraw from the contract without any penalty and without specifying the reason. To exercise the right of withdrawal, the Customer must send a written communication to the following email address: info@iltrenino.it, containing: I) the expression of the will to exercise the right of withdrawal pursuant to art. 64 of Legislative Decree 206/2005; II) the indication of the Products for which the Customer wishes to exercise the right of withdrawal; III) the progressive order number issued at the time of purchase; IV) the data relating to the Customer's bank account. The communication can be sent within 14 (fourteen) working days from the date of receipt of the Products. The Customer undertakes to return the Products within 14 (fourteen) working days from the date of receipt of the Products to the following address: Ele srl – Via Tazio Nuvolari 7, 55012 Capannori (LU)
8.2 The costs for returning the Product are entirely borne by the customer. ELE will not be responsible for the refund or compensation for those returned products that are gone, lost, stolen or damaged.
8.3 ELE will refund the full cost of the Products returned by the customer. In order for withdrawal to be possible, the product must be intact and returned in the original packaging complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, tags, etc.). Delivery costs are not refundable. ELE will undertake to refund the Customer promptly and in any case no later than 30 (thirty) days from the date of Return provided that the conditions of the previous paragraph have been respected. Refunds will be made by bank transfer. ELE will send a notification email once the refund has been made. ELE reserves the right to refuse the return of those Products that do not comply with the requirements set out in the previous paragraph 8.1.
9. Cancellation of Order Modification
9.1 If the Customer wishes to modify or cancel the order submitted, he/she must promptly send an email to the address: info@iltrenino.it ELE will do everything in order to satisfy the Customer's request. However, once the Product has been shipped, the order cannot be cancelled or modified until the shipped goods have been returned to ELE. In this case, reference is made to the provisions contained in the previous paragraph 8.1.
10. Warranties, Defects of Conformity, Complaints
10.1 ELE issues, pursuant to Legislative Decree no. 206/2005, a legal guarantee on the product for non-compliance of the same with the qualities provided for in the sales contract in compliance with the applicable legislation. If a Product sold by ELE should present a defect or non-conformity, the Customer must immediately contact and no later than 45 (forty-five) days, the Customer service at info@iltrenino.it, mentioning the proof of purchase. ELE will provide, in agreement with the Customer, for its replacement or refund, communicating the methods.
10.2 If the Customer is not completely satisfied or if there is a discrepancy with the order placed by the Customer, the Customer must keep all the documentation and the Product in its packaging and immediately contact ELE by email at the following address: info@iltrenino.it ELE will provide, in agreement with the Customer, the replacement or refund by communicating the methods to him.
10.3 “Consumer” customers, as defined in paragraph 8.1, are recognised the consumer rights set out in art. 130 of Legislative Decree 206/05. Such rights must be exercised within the terms set out in art. 132 of Legislative Decree 206/05.
11. Product Liability
11.1 The provisions of Directive 1999/34/EC apply with regard to damage caused by the product. ELE, as a distributor, disclaims liability by indicating the name of the manufacturer.
12. Privacy
12.1 ELE declares and guarantees that the Customer's personal data will be processed in accordance with the provisions of Legislative Decree of 06.30.2003 n. 196 and subsequent amendments. The details relating to the methods of data processing are communicated to the Customer at the time of registration referred to in the previous paragraph 4.2.
13. Errors and inaccuracies
13.1 ELE aims to provide constantly updated information on the Site. However, it is not possible to guarantee that the Store is completely free from any errors. The Store may contain errors, inaccuracies or omissions, some of which may refer to the price and availability of the Product, and to the information sheet of the Product itself. ELE reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also reserves the right to change or update the information at any time without prior notice.
14. Guarantee of authenticity
14.1 The original products branded IL TRENINO / IL TRENINO MINI / OIOO are sold on the internet exclusively through the website shop.iltrenino.info
15. Intellectual Property
15.1 All intellectual property rights such as trademarks, service marks, form marks and copyrights are the exclusive property of ELE. No page or content of this Store may be reproduced, transferred, modified, linked and used for public or commercial purposes without prior express written permission.
16. Applicable law, dispute resolution, competent court
16.1 The conditions of access to the Store are governed by the provisions of Italian law and must be interpreted in accordance with Italian law.
16.2 In the event of a disservice or dispute between ELE and the Customer, we hereby guarantee our participation in an attempt at amicable conciliation.
16.3 For any action arising from or related to the conditions, navigation or use of the Store, the Court of Milan will have jurisdiction.

Refund Policy
1. Right of Withdrawal
